GENERAL TERMS AND CONDITIONS

The following general terms and conditions (the "GTC") apply and govern the use of the website https://www.standspeakriseup.l... (the "Website") of the Fondation du Grand-Duc Henri et de la Grande Duchesse Maria Teresa, established and having its registered office at 8, an der Sang, L - 7739 Colmar-Berg, and registered with the Luxembourg Trade and Companies Registry (Registre de Commerce et des Sociétés, Luxembourg), under Section G Number 72 (the "Organizer").

By continuing to browse the Website, the User, as defined below, acknowledges having read and understood these GTC and agrees to be bound by them.

These GTC are not intended to circumvent the requirements of any applicable law or to exclude liability in cases where it cannot be excluded under applicable law.

USER COMMITMENTS

Access to the Website is via the Internet. Anyone using the Website (a "User" or "Users") declares knowing and accepting the risks associated therewith.

By using the Website, the User understands and agrees that its access is provided "as is" and "as available", without any express or implied warranties in that regard.

By using the Website, the User understands and agrees that its use is governed by the Website’s conditions and technical use restrictions in terms of compatibility and interoperability (the "Technical Conditions"). The User agrees to comply with these Technical Conditions.

By using the Website, the User confirms that he/she has the appropriate computer hardware to use the Website and agrees not to use any device or to take any action that may harm the Organizer.

The User shall take all measures to guard against the effects of computer piracy by adopting a suitable and secure computer configuration. The User shall take all necessary actions to limit any damage that may result from the possible corruption of his/her computer hardware when accessing the Website.

By using the Website, the User guarantees at all times that he/she will not use the Website to:

  1. undertake or promote illegal activities, or spread misleading or deceptive information;
  2. unlawfully or without authorization, copy works protected by copyright, patents or trademarks;
  3. stimulate, incite or encourage the sending of emails, chain letters, mass unsolicited emails, instant messages, unwanted advertisements or unsolicited mail;
  4. promote or encourage any criminal act or activity, or provide guidance or direction on the promotion of criminal activity, invasion of privacy, dissemination or creation of computer viruses;
  5. solicit passwords or personal information from other Users for unlawful business purposes;
  6. distribute, reproduce, publish or modify materials protected by copyright, trademarks or other exclusive rights that third parties hold, in any manner, without their prior consent.

AVAILABILITY OF THE WEBSITE

The Organizer cannot guarantee the continuous and permanent accessibility to the Website. The Organizer will use its best efforts to provide maximum Website accessibility in the most efficient way possible for the User.

The Organizer reserves the right to develop, modify or suspend, without notice, the Website for reasons of maintenance, updating, or for any other reason deemed necessary (an "Access Interruption"). By using the Website, the User understands and agrees that any Access Interruption shall not constitute an error on the part of the Organizer under these GTC. The interruption of access to the Website shall not give the User a right to compensation.

By using the Website, the User acknowledges the characteristics of the Internet network and agrees that the Organizer cannot be held responsible for any eventual interruptions to the Internet protocol system resulting from an act of the Internet service provider or any act that eludes the control of the Organizer.

The Organizer shall ensure the security of the computer system in the best manner possible. However, its liability cannot be triggered in case of an attack on the computer system or temporary or total inaccessibility of the Website.

More generally, the Organizer declines all liability in the event of the Website’s Access Interruption, malfunctioning or any loss of data resulting from:

  1. non-compliance with these GTC, the Technical Conditions or the recommendations of the Organizer;
  2. inappropriate or illicit use of the Website;
  3. cases of force majeur;
  4. third-party events such as those caused by telecommunications operators;
  5. acts or omissions of the User.

CONTENT OF THE WEBSITE

The Organizer shall ensure the accuracy of the information or services on this Website in the best manner possible. However, its liability cannot be triggered in particular in case it omits to update information or a form; in the event of errors in the handling of the system or encoding; inaccuracies, gaps in information provided or any errors, inaccuracies or other omissions. The aim is to disseminate accurate and up-to-date information from various sources; however, the Organizer cannot avoid all risk of material error. None of the information published on this Website is intended to be exhaustive or constitute a commitment on the part of the Organizer.

The Organizer may at any time withdraw, add, complete or specify all or part of the information and services contained or proposed on the Website (the "Modifications"). No liability for any direct or indirect damage in connection with such Modifications may be held against the Organizer.

HYPERTEXT LINKS AND RELATED SITES

By using the Website, Users may be required to click on links that will redirect them to third-party service providers. The Organizer cannot be held responsible for the inaccessibility of the websites or the services of those third parties. In general, the Organizer cannot be held responsible for the functioning, the content, the legality or the accuracy of the information or any other aspect of third-party sites or services or for any direct or indirect damage caused by following a link to a site or service of a third-party service provider.

REPORTING OF TECHNICAL PROBLEMS

In the context of the use of the Website, the User may open a ticket, via the contact form, to report technical problems in case of inaccessibility of the Website following technical failures caused by the Organizer, and failing their resolution in a short time, the Organizer will use its best efforts to resolve such deficiencies as soon as possible, provided that:

  1. the User has described them precisely when opening the ticket,
  2. the User cooperates fully with the Organizer; and
  3. such failures do not result from any misuse of the Website attributable to the User.

INTELLECTUAL PROPERTY (COPYRIGHT)

The Website, all its elements (including the layout) as well as the information and services are protected by the laws on intellectual property and copyrights. The Website remains the exclusive property of the Organizer.

Unless otherwise indicated, the Organizer does not grant any license or authorization relating to the intellectual property rights that it has on the Website, its elements or the services. The provision of access to the Website does not constitute a transfer of intellectual property rights to the User.

Moreover, no reproduction of the information or services, in whole or in part, in any form whatsoever and by any means whatsoever, is permitted without the prior written authorization of the Organizer.

Unless otherwise indicated, the User is authorized to consult, download and print the documents and information available on the Website under the following conditions:

  1. the documents may only be used for personal use, for information, and in a strictly private context;
  2. the documents and information may not be modified in any way;
  3. the documents and information may not be disseminated outside the Website.

The rights that are implicitly or explicitly granted above to the User constitute an authorization of use and in no way constitute an assignment of rights, property or other relating to the Website.

RIGHT TO IMAGE

After validation of his/her registration deposited via the Registration Form, the User may attend the Event.

The User is informed that he/she may be photographed or appear on videos during his/her participation in the Event. By accepting these GTC when validating the Registration Form and attending the Event, the User consents to being photographed or filmed.

By checking the box in the Registration Form, the User consents to the publication of photographs and videos, in paper or digital format, via the usual media channels.

PRESENCE ON SOCIAL NETWORKS

Abusive, racist, sexist or offensive comments have no place on social networks. They will be deleted and reported.

From Monday through Friday, between 08.00 and 18.00 hours, comments will be received on the Facebook page, Twitter, LinkedIn and Instagram accounts of the Organizer or Event. Outside of these hours, as well as during weekends and holidays, those social media are not maintained on a continuous basis.

On social networks, the Organizer communicates in French and English. Depending on the situation, information may be disseminated in other national languages. Whenever possible, all questions/comments of the User will be answered in the User’s language.

COOKIES MANAGEMENT

The Website may use cookies. These are small text files used to analyze the information relating to the User's browsing (frequency of visits, length of visits, pages consulted, language preferences, etc.). They are deposited by the Website in a directory provided for this purpose on the User’s computer. They include the name of the server that wrote it, an identifier as a unique number and an expiration date. The unique identifier allows the Website to recognize the User's computer at each visit.

The User himself/herself can decide whether the Website’s server is authorized or not to memorize cookies on his/her computer. He/she may choose at any time to adjust the options of his/her browser so that cookies are not accepted and stored. The Organizer encourages Users to check frequently if any changes have been made to this page. Users acknowledge and agree that it is their responsibility to regularly review these GTC and to inquire about changes hereto.

VIOLATION OF THE GENERAL CONDITIONS

In case of violation by a User of his/her obligations under these GTC, the Organizer may prohibit or suspend access to the Website without prior notice and without compensation to the User concerned.

LIABILITY

The Organizer may not be held liable for any damage that the User would suffer directly or indirectly in connection with its navigation on the Website and the use of its services and the websites to which it refers.

APPLICABLE LAW

Any dispute relating to the use of the Website and its services shall be subject to Luxembourg law and, if the User and the Organizer are not able to resolve the dispute amicably, will be subject to the exclusive jurisdiction of the courts of the Grand Duchy of Luxembourg.
